Are Pounds and Shelters exempt from Microchipping a dog or cat prior to sale under the Animal Management Act?

Can somebody clarify pounds have to microchip an animal before they sell it or give it away? The Animal Management (Cats and Dgos) Act 2008 states that a suplier must ensure an animal is implanted with a microchip before sale of the animal, however I heard that pounds and shelters are exepmt. Does anybody know if this is true, and if so where abouts in the Act can I find where it says it?? Thanks heaps.

No this is certainly not true. Pounds and shelters not only have to microchip pets before they are rehomed, they are legally obligated to have them desexed before they can be rehomed, as well.

As I said: Different in every state so you really need to clarify which state you are in.
In Victoria at least you cannot register an animal unless it is microchipped (the exception is an animal that was registered before the law came out years ago- but if it changes hands it needs to be chipped.)
To adopt an animal from a shelter it must comply with council regulations- so it needs to be registered when adopted and therefore must be microchipped in order to be registered.
The act also states it is an offence to rehome an animal without microchipping it first.
